WHAT WERE THE REAL CIRCUMSTANCES THAT CAUSED AL PETTY TO MAKE THE DECISION TO RE-LOCATE THE OPERATION OF TELECOM2000 TO CANADA?
COMMENT: Throughout the trial, and prior to the trial, the government consistently accused AL PETTY of moving the operation to Canada "to evade the scrutiny of the REGULATORY AGENCIES". Absolutely no evidence or testimony was given to substantiate those false allegations, yet the Jury was consistently lied to about this. Also, AL PETTY'S sentence was increased by several years because of these false statements.
TO ANITA BANKS - GOVERNMENT WITNESS - EMPLOYEE OF AL PETTY
KENNER: (V2;P134;L13-25) "NOW, AFTER THE CONVENTION, DID A GROUP OF CONSULTANTS FROM CANADA COME TO TELECOM2000?"
BANKS: "YES, YES. WELL IT STARTED OUT AS JUST ONE INDIVIDUAL, SABRINA, AND THEN - AFTER THAT - SOME OF HER COMPANY, I GUESS MEMBERS OF HER COMPANY, ALSO CAME DOWN."
KENNER: "WHAT DID THEY DO?"
COMMENT: Anita Banks worked the Midnite Shift. She was not present, therefore, during the primary time that the Canadian Crew was working, (however, much of the time the Canadian Crew worked 24/7 in their efforts to help the Local crew catch up) - including the sabotage damage from the employees who were neglecting their duties, even though AL PETTY was paying them up to $50 - $90 per hour to perform their services for the TeleCom2000 Business Owners!
BANKS: "WELL THEY WERE BROUGHT DOWN, APPARENTLY, FROM WHAT MR. PETTY TOLD US, TO HELP US CATCH UP BECAUSE THE BUSINESS HAD GROWN UP BY SUCH LEAPS AND BOUNDS IT WAS NEXT TO IMPOSSIBLE TO KEEP THE STUFF FLOWING AS RAPIDLY AS WAS NEEDED FOR THE CLIENTS."
COMMENT: Of course Anita was not aware of the sabotage being committed by HALLEY & MAYO for the FBI.
KENNER: "NOW, HOW MANY TIMES DID THEY COME TO TEXAS?"
BANKS: "AT LEAST TWO THAT I KNOW OF, POSSIBLY THREE."

BANKS: "YES."
COMMENT: Clearly the move to Canada was motivated ONLY in order to enhance the operation of TeleCom2000 to better serve the Business Owners. In full recognizance of this FACT, the prosecution alleged from the freezing of the funds on April 4, 2002 through the sentencing on April 10th 2003 that "AL PETTY moved the business to Canada to escape the scrutiny of Regulatory Agencies." Obviously the Jury believed this - yet another - LIE! The ONLY reason it was moved was for increased efficiency.

PEJOVICH: "YES, SIR."

PEJOVICH: "I WAS TOLD THAT THERE WAS GOING TO BE A CIVIL SUIT AGAINST MR. PETTY, AND THAT - JUST TO AVOID THE PUBLIC - WHATEVER WAS GOING TO HAPPEN UP THERE WITH THE BUSINESS, THEY DIDN'T WANT BAD PUBLICITY FOR THEIR NAME, THAT THEY WERE GOING TO MOVE EVERYTHING TO CANADA - - -
SMITH: "OKAY. SO THE BUSINESS OPERATION ITSELF WAS GOING TO BE SHIPPED TO CANADA.

SMITH: "TO MAKE SURE THAT THE MONEY WAS ACCOUNTED FOR, AND THE CHECKS THAT WERE WRITTEN IN ACCORDANCE WITH THE CONTRACTS? - - -

SMITH: "WE'RE TALKING ABOUT INTENT NOW, MR. PEJOVICH. YOUR UNDERSTANDING OF THE INTENT IS THAT THEY WERE GOING TO DO THE SAME THING IN CANADA?"
PEJOVICH: "SURE."
SMITH: "THAT THEY WERE DOING HERE, EXCEPT THEY WERE GOING TO DO IT FASTER?"
PEJOVICH: "THAT'S WHAT I ASSUMED, YES."
SMITH: "AND THEY COULD DO A LOT MORE, SO FAR AS VOLUME IS CONCERNED, AND THE EQUIPMENT THAT YOU HAD PURCHASED AND SHIPPED TO CANADA?" (Note: Purchased $300,000 equipment.)
PEJOVICH: "I WOULD THINK SO, YES. I THINK THEY COULD HAVE DONE MORE UP THERE."
COMMENT: When Pejovich gave the reason for the move as "to avoid bad publicity", he was - for the sake of the government, for whom he was a witness, he was neglecting to give the Jury the REAL reasons for the move. IF he would have elected to tell the truth, he would have told the court:
1) "I, IVAN PEJOVICH, recommended the move to Canada for operations, many times to AL PETTY, because:
A) I was convinced that the LOCAL CREW COULD NOT service the TeleCom2000 Business Owners properly.
B) I KNEW that the "Canadian Crew" could "get the job done." I worked with them day and night and they were simply the most efficient workers and "computer - guru's" I have ever seen. C) I KNEW about the "Blackmail threats" from MAYO, HALLEY AND BANKS. In fact I'm the one who TOLD AL PETTY about them. Therefore I had NO REASON to continue belief in - or support of - the LOCAL CREW. D) I URGED AL PETTY to make the move, I supervised the move and set the equipment up in Canada. E) I also LIED to the FBI by telling them that I did not remember ANYTHING about my meeting with AL PETTY on Good Friday 2002, when I URGED him to move the operations to Canada to ensure the enhanced continuation of his TeleCom2000 Network."Instead of the above, whether it was because of his fear that the FBI would extradite him to his native MONTENEGRO and seperate him from his American wife and baby, PEJOVICH simply LIED to the Jury!
