RESPONSE TO NEWS RELEASE

To the initiators & recipients of the "DIRECTOR'S AWARD" on Nov. 10, 2004:

The above mentioned news release has recently been brought to my attention.  As a proud TELECOM2000 BUSINESS OWNER, I am one of the 2500 "VICTIMS" mentioned in your press release.  However, I am NOT a victim of AL PETTY; I am a VICTIM of the FEDERAL GOVERNMENT'S system of "JUST-US"! AL PETTY kept every contractual commitment he made to me, UNTIL the Federal government abruptly - & without a single complaint of deceptive or fraudulent activity - seized the funds of TELECOM2000.

I would think that - in upholding their lawful obligation of PROTECTING it's Citizens - the FBI would have shown its respect, not only for Al Petty, but for the financial lives of the 3,000 TELECOM2000 Business Owners, by merely contacting Al Petty.  It is obvious that the FBI agent, James Hersley, did not grasp the complexities and significance of Al Petty's Long Distance, Cell Phone, Digital Marketing & outsourcing of offices.  IF the government had truly desired to protect its Citizens, rather than prosecute them, they would have sat down with him & asked Al Petty to explain the digital technology that enabled him to cut the cost of Long Distance, Cell Phone & Marketing Services by 90%, as compared to AT&T & Sprint, etc.

There was absolutely no reason for the government to ruin the lives of 3,000 of its Citizens by confiscating, (& squandering!), their funds.  And there is certainly no justification for spending millions of the taxpayers dollars to put Al Petty who - during his 69 years had never had even a brush with the law - in prison for 24 years, (life sentence?)  IF Al Petty did not have the proper licenses & permits to conduct TELECOM2000, everything could definitely have been put in proper perspective with proper communication.  There was no reason for the government to confiscate 250,000 documents from Al Petty's meticulous computer & audio records.  And there was no valid logic in the government spending millions of the taxpayer's dollars, while devoting a full year of the heavily backlogged Judicial system - diverting them from the very-real war on terrorism, as well as protecting its Citizens from the murderers, rapists, robbers & REAL 'white collar criminals,' such as BERNIE EBBERS & SCOTT SULLIVAN of WORLDCOM.

Tens of thousands of victims of these criminals' deceptive & fraudulent schemes were robbed of 11 Billion Dollars! Any or all of these true victims would have been eager to testify against these REAL CRIMINALS.  To the contrary, the government made EVERY EFFORT to find even ONE TELECOM2000 BUSINESS Owner who had EVEN complained, or that would testify that Al Petty deceived or defrauded them!  As you know, after robbing thousands of clients of 11 Billion Dollars, Ebbers got 25 years & the snitch - who actually was the architect of the robbery - received only 5 years.  Yet, Al Petty, against whom the government could not find even one witness, was given - at the age of 70 -? a "Life Sentence" of 24 years, & now the gov't is 'bragging' about it!

I find it absolutely UNBELIEVABLE that the government would "HONOR" its prosecutors & agents for putting a man in prison 24 years who had NEVER committed a crime, & whose revolutionary digital concepts were generating 12 million dollars per year in IRS taxes alone!  I ask you "WHO IS A MENACE TO SOCIETY"?  Is Al Petty, who never hurt, only helped, his fellow Citizens, & enabled them to pay the government 12 million dollars per year, is Al Petty a menace to society, or are the real "threats to society" those who robbed Al Petty & 3,000 TELECOM2000 Business owners of millions, as well as depriving the government of 12 million dollars a year?  Yet - in lieu of being critical of the prosecutors & agents for their roles in this robbery, they were "HONORED" by the ATTORNEY GENERAL for their self-serving acts of "JUST-US"!

You also stated in your news release that AL PETTY was found guilty of "perpetrating an international Ponzi scheme".   I remind you that a "PONZI SCHEME charge" never appears among the 98 Counts FOR WHICH Al Petty WAS ON TRIAL!  How can the government boast about convicting a man for charges that were not even in his indictment, & for which he was not even on trial?

When one considers the terribly unfair scheme used by the government to get a guilty verdict, it becomes 'doubly injurious'!  While, according to my understanding of the law, Al Petty was still INNOCENT, (since he had NOT been proven 'guilty beyond a reasonable doubt'), the government - in effect - before it even 'declared war' on him, took all of his means to defend himself!  They seized his money, so he could not hire adequate counsel, & his assets, as well as his computer records, (making them available for his defense ONLY from THEIR property, under THEIR supervision, at AL PETTY'S expense!) However, the government unleashed their UNLIMITED RESOURCES of money, time, personnel & computer equipment against a man they had rendered virtually helpless! Is it not a CRIME to steal the funds of an INNOCENT man, such as Al Petty?

To me, what you have done in presenting, & receiving, this award is as insulting as it would be to present an award for skill, bravery & achievement to 5 thugs who beat up & robbed a senile 95 year old man of $3.85!  Al Petty was robbed of his abilities to defend himself, & then as in the case of the old man, without provocation or reason, Al Petty was attacked by the same Federal Government that is sworn to protect him & his TELECOM2000 Business Owners, such as myself!

On page one of your news release, you stated that "AL PETTY OPERATED THIS: (1) FRAUDULENT TELEMARKETING SCHEME - - -  By (2) GUARANTEEING 500% TO 1100% RETURN ON (3) INVESTMENTS."  As in your press releases from the inception of your war against us, there are THREE FALSE, & or, misleading statements in only this one line of your government press release:

1) The absolute IMPOSSIBILITY of the government to find even ONE complaint - much less charge - of fraud, (from 3,000 TELECOM2000 BUSINESS OWNERS, SHOULD PROVE to ANY LOGICAL PERSON that AL PETTY did NOT defraud ANYONE! I cannot understand how - in the name of Justice - that you could print such an absurdity; stating that he OPERATED A FRAUDULENT SCHEME?  IF Al Petty was operating a 'FRAUDULENT SCHEME, SURELY at least ONE person of 3,000 Business owners during 27 months, would have at least, complained that they were defrauded!

2) I've never heard of anyone being convicted of breaking the law by GUARANTEEING their product or service.   It's a FACT that a major factor in Wal Mart's becoming the world's largest employer & wealthiest Company is that they offer products at the lowest prices of anyone.  And, to back up their unbelievable prices, they GUARANTEE customer satisfaction of these unprecedented values - No questions asked!  The product would have been of no lasting value without the GUARANTEE.  And the GUARANTEE would have been of no value, UNLESS Wal Mart stood behind it!  Not unlike Wal Mart, Al Petty MADE the GUARANTEE, AND he stood behind it - 100% of the time!  He DELIVERED TELECOM2000'S GUARANTEE of unprecedented returns of 500¬1100%.  How do I know?  I know because hundreds of TELECOM2000 Business Owners HAVE THE CHECKS TO PROVE IT! (INCLUDING ME!)

Of course the blatant IMPLICATION of your statement in the press release is that Al Petty could not, & did not, honor his guarantee!  This is the same method of deception the government used from the beginning to convict an innocent man & rob 3,000 Business Owners!

3) Although virtually EVERY WITNESS corrected you at the trial when you called our PURCHASES of TELECOM2000 Businesses an 'investment', although you KNOW that TELECOM2000 was NOT a bank or broker, although you KNOW that EVERY transaction was for the PURCHASE of a TELECOM2000 OUTSOURCED BUSINESS - Not an 'INVESTMENT' - but because it is to your advantage to call the PURCHASE an 'INVESTMENT' you continue your 'path of deception & lies', by calling my PURCHASE AN 'INVESTMENT'.  I said all 3 of the above items just to correct ONE of your many - & continuing - efforts to deceive the public & JUSTIFY your fraudulent conviction of Al Petty - TELECOM2000!  Then you continue your 'pattern of deception' by stating that "TELECOM2000 WAS AN INVESTMENT SWINDLE".  It was NOT an 'INVESTMENT' - & All testimony & evidence PROVES it was NOT a 'SWINDLE'!

Then you state - implying that AL PETTY is the one who committed the crime - that "OVER 2500 'INVESTORS' WERE DEFRAUDED OF OVER $17,200,OOO".  You KNOW that virtually every witness - during the trial, when the subject arose - even your own subpoenaed TELECOM2000 Business Owner witnesses - pointed their fingers at you, the PROSECUTION, and identified YOU as the ones who VICTIMIZED them!  Even in this age of DNA identification, when - WITHOUT EXCEPTION - EVERY VICTIM IDENTIFIES THE SAME 'PERSON' AS VICTIMIZING THEM - NO PERSON OR COURT WOULD INSULT THE INTEGRITY, MEMORY & INTELLIGENCE OF MORE THAN 20 WITNESSES WHO ALL IDENTIFIED THE GOVERNMENT AS THEIR 'VICTIMIZERS', (the CRIMINALS)!  Yet you continue to state that AL PETTY victimized me!  Let me tell you, although I was not able to be a 'trial witness', I was NOT a victim of AL PETTY.  I WAS, AND AM, YOUR VICTIM!

On page 2 of your news release you stated that "Petty WENT TO TRIAL ON 98 CHARGES OF WIRE FRAUD, MAIL FRAUD and MONEY LAUNDERING".  You & I both know that the REASON the jury convicted him on those 98 counts was NOT because he COMMITTED, or INTENDED to commit, ANY FRAUD, & therefore, with no fraud, there was no Money Laundering!

The transcripts clearly indicate that the fraudulent testimony of your expert witness - totally based on false & fictitious figures of up to $920,000,000,000 (NINE HUNDRED TWENTY BILLION DOLLARS!) was THE testimony that enabled you to obtain a guilty verdict from the jury!  Professor William Cunningham was a MASTER MANIPULATOR, and ENEMY, OF THE TRUTH.  After your devoting over a year, & millions of us taxpayer's dollars to your efforts to fabricate a case against Al Petty, you KNEW that ALL CONTRACTS with TELECOM2000 were based on an 80% to 96% payment of the 500% to 1300% commission return that was GUARANTEED, (& NEVER FAILED), to be paid within the first SIX MONTHS of each purchase of an outsourced business, including the promotion of my business that I paid Al Petty for doing. You KNEW, therefore, that CUNNINGHAM was BLATANTLY LYING, DECEIVING & DEFRAUDING the court, jury, justice, Al Petty & 3,000 Business owners when he did the following:

(1) Used a false figure of 14,035 contracts, as being totally unpaid.  You knew that all contracts other than the 350 Contracts received in March & April of 2002 had been paid - either in full, or in part!  You encouraged, & obviously conspired with Cunningham therefore, to use a FALSE number of 14,035 totally unfulfilled Contracts on which he based his entire perjurious testimony. You KNEW the TRUTHFUL number of totally unpaid contracts was 97.5% LESS than 14,035 - only 350 contracts.  Of course even if his subsequent figures had been based on actual figures - which they were not - his final, total fraudulent figure of $920,000,000,000 (NINE HUNDRED TWENTY BILLION - almost a TRILLION DOLLARS!) would have been in error by about $892,800,000,000, (EIGHT HUNDRED NINETY TWO BILLION DOLLARS!)

(2) The second lie that CUNNINGHAM, (with your instigation), based his 'deceit of the jury' on was his testimony - under oath to testify TRUTHFULLY - was that Al Petty was contractually obligated to continue to renew 'six month contracts', as well as offer new contracts, for a period exceeding SIX MONTH'S BUSINESS COMMISSIONS.   In FULL COGNIZANCE of the 1  'six month only' Commission Contract, you BLATANTLY BLEW REALITY INTO ABSURD FANTASY with your EXPONENTIAL MULTIPLICATION of six months, compounding CONSECUTIVE CONTRACTS for a 5 or 6 year period, KNOWING that the ONLY time frame for your projection that you could TRUTHFULLY testify to was the ONE SIX MONTH PERIOD REMAINING ON ONLY 350 CONTRACTS, as opposed to 14,035 contracts, multiplied EXPONENTIALLY, over a SIX YEAR, PERIOD!  WOW! And to think you received a prestigious DIRECTOR'S AWARD for your 'CONSPIRACY TO CONVICT AN INNOCENT MAN' & rob me & 3,000 other TELECOM2000 Business Owners!  SURELY YOU ARE NOT AS CORRUPT AND EVIL AS YOU APPEAR TO BE, BASED ON WHAT you've DONE TO US???

I could continue on & on, but allow me to mention one other area for your "Letter of Congratulatory Director's Award".  You state "PETTY WAS SENTENCED to 292 MONTHS, (over 24 years!), IN PRISON, THOUGHT TO BE THE LONGEST TERM OF IMPRISONMENT EVER IN A TELEMARKETING SCHEME." It is totally beyond my comprehension that you would boast, & receive an award, for putting a 70 year old, law-abiding, Citizen whom you could find absolutely NO testimony or evidence of ANY illegal activity, in prison for over 24 years, virtually a LIFE SENTENCE!  WOW! Surely you are aware that:

(1) BERNIE EBBERS was convicted with thousands of CONFIRMED

VICTIMS, of defrauding his investors of $11,000,000,000, (ELEVEN BILLION DOLLARS), yet Ebbers received only a few months' longer sentence than you boast of inflicting on Al Petty!

(2) SCOTT SULLIVAN, the actual 'ARCHITECT' of the WORLDCOM CRIME, chose to snitch on Ebbers.  This is an excellent example of the OBVIOUS FACT that the 'PUNISHMENT SENTENCE', for committing a crime is NOT because they are a "threat" or "menace" to society!  Sullivan received only 5 years, although he was the confessed ARCHITECT of a CRIME that DEFRAUDED thousands of Citizens out of $11 Billion Dollars!  Personally I would consider EBBERS, who at least had the guts to go to trial, & refused to snitch on his associates, I would "trust" him with my money, (although I actually wouldn't trust EITHER of them), before I would trust a confessed liar & thief, who chose to accuse others, send them to prison, & - no doubt - LIE to the GOVERNMENT TO SAVE HIS OWN SKIN.  It should be obvious WHICH of these men was, & always will be, a GREATER THREAT TO SOCIETY!  Certainly SULLIVAN is, yet when he's released from prison, the man who the government admitted they had no case against Ebbers, without SULLIVAN'S SNITCHING; Ebbers will still have - if he survives prison? - over 20 years REMAINING IN PRISON!  I ask you again, does our Federal System sentence a person based on the degree of the crime committed, as well as on the legal perception of the convicted person's being a 'menace to society'? Obviously not!  I ask, "Is the current objective of the Justice System to PROTECT its Citizens by putting persons who are a threat to society in prison, & KEEPING them in prison, based solely of their crime, or does the government now consider a person who commits a horrible crime, such as an 11 Billion dollar fraudulent swindle of tens of thousands of Citizens, does the government think that the person, like SULLIVAN, is LESS of a threat & criminal than he would have been, SIMPLY BECAUSE HE CHOSE TO SNITCH - and probably LIE - on an associate to SAVE His OWN SKIN?  The answer, sadly, is evident.  The government does NOT sentence a person based on their crime.  The harshest sentences are reserved ONLY for those WHO DARE to tell the TRUTH WHEN THEY ARE NOT GUILTY - SUCH AS AL PETTY DID - & CHALLENGE the (in their minds, OMNIPOTENT), Federal government by taking them to court? The TRUTH is that 'SENTENCES BASED ON THE CRIME" has long since NOT been the 'Criteria of sentencing'!  In a VERY REAL SENSE, the government tells a person like Al Petty, "ADMIT YOUR GUILT BY PLEADING GUILTY - whether you are or not - & HELP US EXPAND THIS CASE AGAINST YOU BY SNITCHING ON YOUR ASSOCIATES, OR EVEN ON PERSONS YOU DON'T KNOW OR HAVE EVER HEARD OF. LET ME MAKE THIS FACT CLEAR! YOUR SENTENCE WILL HAVE VERY LITTLE - IF ANYTHING - TO DO WITH YOUR CRIME!  THE SEVERITY OF YOUR SENTENCE WILL BE DETERMINED BY WHETHER YOU HELP US WITH OUR CAREERS, (as in helping you get the DIRECTOR'S AWARD), BY SNITCHING ON OTHERS.  JUST DON'T DARE TO CHALLENGE US IN COURT! NINETY-NINE TIMES OUT OF A HUNDRED WE'LL BEAT YOU UP & SENTENCE YOU to 5 or 10 TIMES THE SENTENCE WE'LL GIVE YOU IF HELP US MAKE AN EVEN BIGGER DEAL OUT OF THIS BY GETTING AS MANY PEOPLE INVOLVED AS WE CAN. IN OTHER WORDS, "THE MORE YOU TALK, THE SOONER YOU'LL WALK! YOU GOT IT?   LET ME MAKE IT CLEAR TO YOU, IF YOU WILL TALK, (PLEAD GUILTY), YOU'RE NOT GOING TO 'DO THE TIME FOR THE CRIME', BUT YOU ,WILL 'WALK IF YOU TALK'!"

(3) Not that it's necessary, but a few more 'CERTIFICATES OF TRUTH' for what I'm saying: AHMED RESSAM was convicted, & pled guilty to, plotting to do billions of dollars damage & kill thousands of people by BLOWING UP THE LOS ANGELES INTERNATIONAL AIRPORT.  He was to get 35 years for this horrible conspiracy, but he started talking.  However, he then decided to stop talking.Then, because he had talked , in spite of the severity of his crime, he only received a sentence of 22 years. He is expected to be released in "13 or 14 years".  Prosecutors; is your "Achievement Award" even more significant because you gave an innocent man TWICE that long who did not commit or conspire to commit, ANY crime?  Has the merits of convicting and sentencing a person, based solely on his crime, been replaced by a criteria of "The crime you commit is not nearly as relative to your sentence as whether you will snitch", 'IF YOU'LL TALK, YOU'LL WALK', regardless of what you have proven you'll do as soon as you're free to harm the Citizens I'm sworn to protect."

(4) In a French Court, 62 defendants who "systematically raped & prostituted children, (45 of them from ages 6 MONTHS to 14 YEARS of age, i.e., a 'mass PEDOPHILA TRIAL, these defendants received from 28 years down to as little as an ACQUITTAL! As if it would comfort the victims & their families & friends, the government even made excuses for their heinous crimes by stating that "nearly all of the accused were abused when they were children".  WOW!  Could it be true that rape & prostitution of children is now less of a crime, & that you can release the criminal sooner - that they are LESS OF A THREAT TO SOCIETY - because 'they were abused as children'?  What EVER HAPPENED TO JUSTICE?  And you, Federal Prosecutors, are bragging about, & receiving awards, (& RE-WARDS), for putting a man away for life who never even had a brush with the law in his 70 - '14/7' years of dedication to making the world a better place to live.

I could site MANY additional "atrocities of Justice", but clearly NONE of them would be as DISGRACEFUL as what you have done to my friend, benefactor & Fellow Citizen, AL PETTY!

PLEASE, IN THE NAME OF HONOR, JUSTICE & for the sake of our great Nation, RECONSIDER the FACTS regarding AL Petty while preparing your response to your LAST OPPORTUNITY to CORRECT YOUR ERRORS, (his 2255).  EXONERATE AL PETTY & RETURN HIM TO SOCIETY ASAP!

In CONSTANT Hope & Prayer, (for 3 years now!), that you will see, admit, & correct the error of your ways. A response would be more than welcome from you.  PLEASE SURPRISE me & respond.
